1. Validity

These general terms and conditions apply to all business relationships between the company Azacca GmbH and its customers. The online shop azacca.ch is operated by Azacca GmbH. All deliveries and services of Azacca GmbH are carried out exclusively on the basis of these general terms and conditions in the version valid at the time of the order. Regulations deviating from these General Terms and Conditions only apply if they have been agreed in writing between us and the customer.

2.0 Offering and Ordering Goods

2.1 Offer

All prices are in Swiss Francs (CHF). The listed prices as well as the detailed product descriptions are not guaranteed. Subject to availability and errors.

2.2 Order

With the order, the customer undertakes to make the payment in accordance with the conditions specified to us and in our web shop and to accept the goods.

2.3 Online Orders

The presentation of the products in the online shop is not a legally binding application, but only represents a non-binding online catalogue. Simply placing products in the "shopping cart" does not constitute a binding order. You only place a binding order for the products contained in the shopping cart by clicking the "Confirm" button on the order completion page.

If the customer withdraws from the same contract after it has been legally concluded, azacca.ch reserves the right to demand a penalty of up to 25% of the order value.

3. Payment

Payment is made by invoice and is due within 10 days of the invoice date. We reserve the right to demand payment in advance in certain cases or in the case of a particularly high order value.

If the customer does not make the payment within the specified period, an amount of CHF 20.00 and default interest of 5% from the due date are due for the second reminder.

The goods remain the property of Azacca GmbH until full payment has been made.

4. Retention of Title

The goods remain the property of Azacca GmbH, 8512 Thundorf, until full payment has been made.

5.0 Other Provisions

5.1 Changes / Adjustments

Azacca GmbH can change these General Terms and Conditions at any time.

Likewise, price changes are reserved.

5.2 Privacy

Personal customer data is treated confidentially in accordance with data protection legislation and is neither passed on to third parties nor sold. Sensitive data, in particular details for payments by credit card, are transmitted in encrypted form for the authorization request. Only data that is required to process the order and that simplify the operation of the online shop for returning customers is recorded.

5.3 Effectiveness

Should individual provisions of this contract be ineffective or unenforceable or become ineffective or unenforceable after the conclusion of the contract, the validity of the rest of the contract remains unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come closest to the economic objective pursued by the contracting parties with the invalid or unenforceable provision. The above provisions apply accordingly in the event that the contract proves to be incomplete.
